Heard learned counsel for the Petitioner, learned Addl. Standing Counsel for the State. Perused the records.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 498-A, 307/34 of the Indian Penal Code.

Considering the seriousness of the allegation, gravity of the offence and the facts of the case, although I am not inclined to grant anticipatory bail to the Petitioner, however it is observed that, in the event the Petitioner surrenders and moves for bail before the learned J.M.F.C.(City), Balasore in C.T.Case No.420 of 2023 arising out of Balasore Sadar P.S. Case No.207 of 2023 within a period of three weeks from today, he shall be released on bail on such terms and

conditions as the learned Magistrate may deem just and proper in the facts and circumstances of the case, but subject to verification of injury. In the event it is found that the injury is grievous, then this order shall not be given effect to. Release of the Petitioner shall also be subject to the condition that the Petitioner shall not threaten, influence, terrorise or harass the informant and her family members and shall maintain the informant properly while on bail. The Petitioner also cooperate with the investigation and shall appear before the I.O. as and when required for the purpose of investigation. Violation of condition shall entail cancellation of bail.

The ABLAPL is disposed of accordingly.
