them. There is no dispute that Late Sadananda Tarasia was the original owner of the land corresponding to Hal Plot No.413 measuring Ac 0.118 decs. There is also no dispute that Ac.0.040 dec. out of the said land was sold by Sadananda Tarasia in favour of Kailash Chandra Lenka on 3rd May, 1988. From the copy of the order passed by the learned Addl. Commissioner, Settlement and Consolidation, it is evident that the plot had not been mutated in favour of Kailash Chandra Lenka (buyer) even till 8th June, 2022. The Petitioners claim to have paid Rs.8,50,000/- towards purchase of the land in question, but not a scrap of document is produced in support of such claim. The claim that the Petitioners verified the voter Identity Card and Aadhaar Card etc. of Sadananda Tarasia to know the genuineness of the proposal is not worthy of belief when one considers the fact that he had expired way back in the year 2017. Whether a person is alive or not cannot be verified by referring to the voter Identity Card and Aadhaar Card etc. rather it would be reasonable to suppose that the Petitioners would make further inquiry about the identity of the proposed seller of the land instead of acting only upon the voter Identity Card and Aadhaar Card. The sale deed dated 26th June, 2023 mentions payment of consideration of Rs.34,65,000/- but as already stated, not a scrap of paper or proof is adduced to show that such amount was actually paid. All these facts, prima facie, show the complicity of the Petitioners in creating the deed in question on the basis of impersonation of the true owner.
