Heard learned counsel for the Petitioner, learned Addl. Standing Counsel for the State. Perused the records.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 292/500/506/509 of the Indian Penal Code and read with Section 67/67(A) of Information Technology Act.

Considering the seriousness of the allegation, gravity of the offence and the facts of the case, although I am not inclined to grant anticipatory bail to the Petitioner, however it is observed that, in the event the Petitioner surrenders and moves for bail before the learned J.M.F.C., Dhamanagar in G.R. Case No.697 of 2023 arising out of Dhamanagar P.S. Case No.405 of 2023 within a period of four weeks from today, he shall be released on bail on such terms and conditions

as the learned Magistrate may deem just and proper in the facts and circumstances of the case.

Further, the Petitioner is released on bail subject to the condition that the petitioner shall not indulge in similar nature of offence and shall not harass, threaten and terrorize the informant or family members and shall cooperate with the investigation and shall appear before the Police Station when required by I.O. for the purpose of investigation. Violation of such conditions shall entail cancellation of the bail applications.

The ABLAPL is disposed of accordingly.
