Learned counsel for the petitioner states that similar matter was carried out by the apex Court and after due adjudication, the apex Court disposed of the same in Amarendra Kumar Mohapatra v. State of Orissa and others, (2014) 4 SCC 583. In view of such position, he states that the petitioner may be permitted to file a fresh representation brining to the notice of the authority concerned with regard to above judgment passed by the apex Court claiming his entitlement with regard to fixation of seniority and consequential benefits, to which learned Additional Government Advocate has no objection.

Considering the contention raised by learned counsel for the parties, after going through the records and without expressing any opinion on the merits of the case this Court disposes of this writ petition granting liberty to the petitioner to file a fresh representation highlighting the grievance which has been raised before this Court in this writ petition within a period of 15 days from today along with a

copy of the judgment in Amarendra Kumar Mohapatra (supra). If the representation is filed within the time stipulated, the concerned authority shall consider the same and pass appropriate order within a period of three months thereafter by affording opportunity of hearing in the light of judgment passed in Amarendra Kumar Mohapatra (supra).
