1. Mr. Mohanty, learned advocate appears on behalf of petitioner and submits, service was made yesterday. Mr. Mishra, learned advocate appears on behalf of the bank.

2. With reference to order dated 16^th May, 2022 Court made query to Mr. Mishra, who submits that if petitioner pays aggregate Rs.22,241/- along with requisite default and processing charges, his client will close the account.

3. Text of order dated 16^th May, 2022 is reproduced below. “ 1 . Mr. Mohanty, learned advocate appears on behalf of petitioner and submits, as on 21^st April, 2017 total outstanding was Rs.22,963/-. His client was told that said amount can be liquidated on One

Time Settlement (OTS). He draws attention to annexure-1 to show several payments made thereafter, between 30^th October, 2017 and 16^th October, 2019 of aggregate Rs.22,241/-. He prays for direction upon the bank to accept the balance and close the account.

2. Mr. Mishra, learned advocate appears on behalf of the bank and seeks service.

3. Petitioner will serve by tomorrow (17.05.2022).

4. List on 18^th May, 2022.”

Petitioner will within a week approach the bank with this order. The

bank will forthwith inform petitioner requisites of charges for closing

¶25

the account. Petitioner will thereupon tender Rs.22,241/- along with

¶26

the charges on or before 31^st May, 2022. The bank will accept the

¶27

same and close petitioner’s loan account. In event petitioner does not tender the amount by 31^st May, 2022, thereafter the bank will act at its discretion.
