“In view of the facts and circumstances stated above it is humbly prayed this Hon’ble Court may graciously be pleased to issue Rule Nisi in the nature of Mandamus and/or any other appropriate writ/writs, order/orders, direction/ directions calling upon the Opp. Party No.2 to show cause as to why they shall not be directed to cancel MetLife Guaranteed Income Plan Policy No.22002292 and 22009303 (Annexure-2 & 2/1) and refund the premium amount collected along with interest as per the award dt. 29.11.2019 (Annexure-1) within a stipulated period;
And, if the Opp. Party No.2 fails to show cause or show insufficient cause and/or false cause, make the said Rule absolute.
And/or pass any other appropriate writ/writs, order/orders, direction/directions as this Hon’ble Court deems fit and proper in the facts and circumstances of the case and in the interest of justice.
And, allow the writ application with cost.
