This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.457/380, I.P.C.

Heard Mr. A.K. Sahoo, learned counsel for the Petitioner as well as Mr. P.K. Pattanaik, learned A.G.A. for the State-Opposite Party.

It is submitted that the Petitioner is inside custody since 30.9.2021 and in the meantime investigation has been completed.

Mr. Pattanaik, learned A.G.A. submits that this Petitioner has 7 criminal antecedents as reflected in the rejection order.

However, considering the period of detention of the Petitioner inside custody and the nature of offences, it is directed to release the Petitioner on bail in connection with Kendrapara Town P.S. Case No.94/2021 corresponding to G.R. Case No.1413/2021 on such terms and conditions to be fixed by the learned S.D.J.M., Kenedrapara as he deems just and proper including the condition that the Petitioner shall not be involved in any other offence while on bail and shall appear before the IIC, Kendrapara Town P.S. once in each week for a period of six months from the date of his

release.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court’s Notice No.4587, dated 25^th March, 2020 as modified by Court’s Notice No.4798, dated 15^th April, 2021 and Court’s Office Order circulated vide Memo No.514, dated 7^th January, 2022.
