The petitioner is in custody since 06.10.2021 in connection with Aska P.S. Case No.647 of 2021 corresponding to G.R. Case No.1218 of 2021 pending in the Court of learned J.M.F.C., Aska for the alleged commission of offence under Sections 399/402 of IPC read with Sections 4 and 5 of

Explosive Substances Act, 1908 and Section 25(1-B)(a) of Arms Act, 1959.

It is submitted that the co-accused persons standing on same footing have been released on bail by this Court as per orders passed in BLAPL No. 10210/2021, BLAPL No. 10421 of 2021 and BLAPL No. 10421 of 2021 and therefore, the petitioner should also be released on bail.

Having regard to the submissions, materials on record, the period of detention already undergone and the fact that the coaccused persons have already been released on bail, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case, failing which it would be open to the trial Court to pass adverse order as deem fit and proper.
