The petitioner has filed this writ petition seeking direction to the opposite parties to approve the service of the petitioner and release his salary.

As it appears, the petitioner is serving as Assistant Teacher and claims for approval of his service and grant of salary from the date of initial appointment.

Mr. S. Jena, learned Standing Counsel for School & Mass Education Department contended that the petitioner claims absorption against a particular post in particular scale,

for which there are several claimants. In view of such position, the claim of the petitioner for absorption does not arise. In any case, the relief sought also cannot be granted as the post has not been created, since it was not justified.

Considering such contention and after going through the record, this Court is of the opinion that since the post has not been created, as it was not justified, the claim of the petitioner for absorption cannot sustain. Therefore, this Court is not inclined to entertain this writ petition, which is accordingly disposed of.
