02 04.03.2021 Heard Mr. A.N. Samantaray, learned counsel for the petitioner and Miss Samapika Mishra, learned Additional Standing Counsel for the State-opposite parties 1 and 2.

The petitioner in this writ petition prays for a direction to the Tahasildar, Karanjia to demarcate the land in respect of Plot No.187 to an extent of Ac.0.30 decimals, Plot No.188 to an extent of Ac.0.04 decimals, Plot No.191 to an extent of Ac.0.02 decimals and Plot No.194 to an extent of Ac.0.01 decimals under Khata No.102 decimals of Mouza-Chadheibhole under Karanjia Tahasil in the district of Mayurbhanj (for short ‘the case land’) within a stipulated period.

Mr. Samantaray, learned counsel for the petitioner submits that although the petitioner filed an application on 20.02.2020 (Annexure-2) for demarcation of the case land, the same has not yet been registered. He further submits that there is no civil suit pending and there is no legal impediment for demarcation of the case land.

Miss Mishra, learned Additional Standing Counsel for the State submits that the petitioner may make an application for demarcation of the case land in proper format along with requisite fee & relevant documents, which can be considered in accordance with law.

Taking into consideration the submissions of learned counsel for the parties, this writ petition is disposed of with a direction that in the event the petitioner files an application before the Tahasildar, Karanjia-opposite party no.2 for demarcation of the case land in proper format along with requisite fee & relevant documents within a period of two weeks hence and proves that he is competent to make such an application, he shall do well to entertain the same and do the needful in accordance with law within a period of four months thereafter after giving notice to the petitioner as well as the boundary tenants to be present at the time of demarcation, if there is no legal impediment.

Urgent certified copy of this order be granted on proper application.
