According to Mr. Panda, the petitioner is aggrieved by non-inclusion of Sevaks from their Nijoga in the Sri Jagannath Temple Managing Committee which is usually constituted under Section 6 of the Jagannath Temple Act, 1955, for short “the Act” to look after affairs of the temple. According to him, though Shri Jagannath Temple, Puri has got around 119 recognized Sevaks as per the record of rights prepared under the Puri Shri Jagannath Temple (Administration) Act, 1952, however, in the matter of nominating Sevaks to the above noted Managing Committee under Clause (j) of Sub-section (1) of Section 6 of “the Act”, only Sevaks belonging to certain Nijogas are being preferred where as the petitioner Nijoga has been ignored all along, though Khuntia Sevaks belonging to the petitioner-Nijoga remain engaged in various works for the whole day in the temple. According to him, Khuntia Nijoga performs about 19 kinds of Seva Puja every day dedicated to Lord Jagannath right from opening of the temple till its closure. He further submits that while Khuntia Sevakas belonging to the petitioner-Nijoga have been ignored, Sevakas belonging to some particular Nijogas are being repeatedly nominated in an arbitrary and unreasonable manner.
