at a belated stage, if party seeking production of documents shows adequate and good grounds for not filing the same at appropriate stage of the suit and also prima facie establishing that the documents are essential and vital to assist the Court to arrive at a just conclusion ( see 1984 (II) OLR 946). But, in the case at hand, no ground is made out in the petition under Annexure-1 itself to consider the case of the plaintiff-petitioner for grant of leave for production of those documents. In fact not a single word is whispered in that regard . It is submitted by Mr. Bose, learned counsel for the petitioner that the petition was filed along with the evidence in affidavit of P.W.5. Thus, it is apparent that the petition was filed at a belated stage without assigning any good grounds for acceptance of those documents. 9. In view of the above, this Court is not in a position to ascertain as to how the documents sought to be produced by the petitioner are relevant for just adjudication of the case. Mr. Bose, learned counsel for the plaintiff-petitioner, however, submitted that the pass book referred to in the said list of documents as per Annexure-1(a) relate to the bank accounts of the above named partnership firm and the company, but in absence of prima facie material to the effect that those are relevant for proper adjudication of the case, this Court is not in a position to accept the submission of Mr. Bose, learned counsel for the petitioner.
