We have perused the report dated 04.02.2021 submitted by the Senior Superintendent Circle Jail, Berhampur, Ganjam which reveals that appellant-Ranjan Naik, S/o.Guruswami Naik has died on 19.02.2010 at 5 A.M. while he was undergoing treatment at M.K.C.G. Medical College and Hospital, Berhampur.
Mr. Mishra, learned counsel for the appellant submits that none of his near relations have come forward to continue the appeal.
Keeping in view the death of the sole appellant, the appeal stands abated.
The Criminal Appeal is accordingly disposed of.
The L.C.R be returned back to the learned Trial Court immediately.
Urgent Certified copy of this order be granted on proper application.
