It appears that the direction issued by this Court on
10.02.2021 has not been complied with.
Sri Sarat Kumar Jena, the Superintendent of Criminal
Revision Section is present in person and stated that he has advised the Petitioner to file an independent application in spite of judicial order. The same amounts defiance of this Court order.
However, he having filed an affidavit seeking apology with undertaking and apology sought for being bona fide, this Court does not want to proceed against him
for such defiance, moreso when the same is not willful.
Accordingly, the office is to carry out the order dated
10.02.2021 forthwith.
In view of the above, the I.A. No.81 of 2021 filed
stands disposed of being infructuous.
