06. This matter is taken up through video conferencing
mode.
Heard Mr.B.Bhuyan, learned counsel for the
petitioner and Mr.G.R.Mohapatra, learned Addl. Standing
Counsel for opposite party Nos. 2 and 3.
Relying on an affidavit filed by Inspector-in-Charge, Niali Police Station Mr.Mohapatra, learned Addl. Standing Counsel submits that pursuant to the order dated 29.6.2020 passed by the learned Civil Judge(Junior Division), Niali in I.A. No. 7 of 2020 arising out of C.S. No. 8 of 2020 the deponent proceeded himself to the spot and found construction work has already been completed and he has also found the opposite party No.1 Dusasan Swain along with his family members are residing in that house. Besides that he submits that on the F.I.R. filed by the petitioner Niali P.S. Case No. 149 dated 11.6.2020 has been
registered and after investigation charge sheet has been filed vide charge sheet No. 305 dated 22.8.2020. Further he submits that two other F.I.R., Niali P.S. Case No. 160 of 2020 and Niali P.S. Case No. 161 of 2020 were registered at the instance of the wife of the petitioner and upon completion of investigation, charge sheet No. 308 dated 23.8.2020 and charge sheet No. 309 dated 23.8.2020 respectively have also been filed before the jurisdictional Court.
In such background, Mr.Bhuyan, learned counsel for the petitioner does not want to proceed further in the matter.
