ORDER 16.08.2021 1. This matter is taken up through Hybrid mode. 2. Defect pointed out by the S.R is ignored. 3. Heard learned counsel for the petitioner and the learned counsel for the State. 4. This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 18.02.2019 passed by the learned J.M.F.C., Ranpur in G.R Case No.407 of 2018 wherein N.B.W.(A) has been issued against him.

It appears that the petitioner was extended the benefit of Section 41A Cr.P.C. but subsequently he having been not responded to the summons issued, N.B.W.(A) was issued against him vide the impugned order dated 18.02.2019. The petitioner is now ready and willing to cooperate with the trial and as such, N.B.W.(A) be quashed and he be allowed to go on bail, submits the learned counsel for the petitioner.

Considering the aforesaid facts and submissions made, this Criminal Misc. Case is disposed of with an order that if the Petitioner surrenders before the Court in seisin over the matter and moves for bail within six weeks hence, the Court in seisin over the matter shall allow him to go on bail on such terms and conditions including the condition that he shall cooperate with the trial and recall the N.B.W.(A) issued against the petitioner and till the expiry of the period of six weeks or surrender, whichever is earlier, there shall be stay execution of the N.B.W.(A) issued in the aforesaid case.
