This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned Addl. Standing Counsel.

The petitioners have raised several grounds before this Court to quash the entire criminal proceeding relating to Sarankul P.S. Case No. 45 of 2020 corresponding to G.R. Case No. 136 of 2020 pending in the Court of learned Nyayadhikari, Grama Nyayalaya, Odagaon.

Mr. Tripathy has taken this Court to the disclosure statement of one Sanjaya Kumar Bisoi recorded under Section 27 of the Indian Evidence Act as also the statement of the accused Sunit Jena, to contend that no case is, prima facie, made out against the petitioners.

However, this Court feels that these are the grounds that can be raised and appropriately considered by the court below at the appropriate stage. The CRLMC is disposed of granting liberty to the petitioner to raise such grounds by filing

appropriate application before the court below at the appropriate stage.

Issue urgent certified copy as per rules.
