Heard the learned counsel for the Petitioner and the learned counsel for the State.

This application has been filed by the Petitioner under Section 482 of Cr.P.C. with a prayer to quash the criminal proceeding in G.R. Case No.1988 of 2001 pending in the court of S.D.J.M., Bhubaneswar.

It appears that the case is of the year 2001. Since then the matter stated to be pending for non-appearance of the other accused persons and as such, the Petitioner has come to this Court for quashment of the same.

Considering the facts and submissions made, this Court while not inclined to entertain the prayer made but, directs the trial court to take all effective steps for early

disposal of the case against the present Petitioner by splitting up of the file, if there is no legal impediment, within a reasonable period since this case is year-old one and for nonappearance of the other accused persons, the case is lingering. So also liberty is given to the Petitioner to raise all the contentions at the time of framing of charge if no case against the Petitioner is made out and in that event, the court concerned notwithstanding reluctance of this Court to entertain the prayer made to quash the order of cognizance, shall pass necessary order in accordance with law without having any binding tie with this order.

However, so far as the renewal of the passport of the Petitioner is concerned, it is observed that if the Petitioner files an application with regard to the same, the same shall be disposed of by the court concerned in accordance with law within one week from the date of filing of such application taking the note of the law laid down in this regard.

With the aforesaid order, the CRLMC stands disposed of. Consequently, I.A. No.506 of 2020 also stands disposed of.
