Heard learned counsel for the petitioner and learned counsel for the State.
This application has been filed by the petitioner for waiving out the condition to furnish cash security of Rs.10,000/-(rupees ten thousand) imposed by the learned Additional Sessions Judge, Bhadrak in its order dated 31.07.2020 in BLAPL No.417 of 2020.
Learned counsel for the petitioner submitted that the offences are triable by Magistrate and the petitioner is extremely poor and he is unable to pay the same and he is still languishing in judicial custody for non-furnishing the cash security and therefore, the same may be waived.
Learned counsel for the State has no serious objection.
Considering the submissions made by the learned counsel for the respective parties, the condition of imposition of cash security of Rs.10,000/(rupees ten thousand) as per order dated 31.07.2020 stands waived and rest of the conditions shall remain unaltered.
Accordingly, the CRLMA application is disposed of.
Urgent certified copy of this order be granted as per rules.
