been filed for declaration of right, title and interest and possession over the suit land and for permanent injunction, came to a conclusion that notice under sub-section 1 of Section 80 C.P.C. should have been issued before institution on the suit against the State and public officers. He further submits that since the possession of the plaintiff is at stake due to notice issued under Annexure-5 for eviction, learned Civil Judge ought to have considered the petition filed under Section 80(2) C.P.C. As such, learned Court committed error in not entertaining the said application. He, therefore, prays for setting aside the impugned order and to issue direction to learned Civil Judge (Senior Division), Kamakhyanagar to entertain the application filed by the plaintiff-petitioner under Section 80(2) C.P.C and also to entertain the prayer for temporary injunction.
