This matter is taken up through video conferencing mode. 2. The Petitioner being in custody in connection with Motu P.S. Case No.57 of 2020 corresponding to T.R. Case No.85 of 2020 on the file of learned Sessions Judge-cumSpecial Judge, Malkangiri running for commission of offence under sections 20(b)(II)(C)/27-A of the NDPS Act, has filed this application under section 439 of the Cr.P.C. for his release on bail.

Heard learned counsel for the Petitioner and learned counsel for the State. Gone through the materials as placed.

Taking into account the submissions made and as the materials on record indicates that as per the prosecution case the seized contraband has not been recovered from the motorcycle said to have been ridden by this Petitioner and its

from the detained Bolero vehicle; further keeping in view the factum of release of co-accused person, namely, Aditya Madhi, who was the pillion rider, on bail vide order dated 13.04.2021 passed by this Court in BLAPL No.6368 of 2020 as also the surrounding circumstances including the period of detention of the Petitioner in custody; in the absence of any such impediment; it is directed that the Petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the court in seisin of the case with further conditions that he shall appear in person before the court in seisin of the case on each date of posting of the case till conclusion of the trial; shall not indulge himself in any criminal activity; and shall not tamper with the prosecution evidence in any manner.

Violation of any of the above condition(s) shall entail cancellation of bail.

The BLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court’s Notice No.4587, dated 25^th March, 2020 as modified by Court’s Notice No.4798, dated 15^th April, 2021.
