The Petitioner by filing this application has prayed for waiver of the condition imposed on him while granting bail as to his appearance before the IIC, Sahidnagar P.S. every Monday in between 10 am to 02 pm till conclusion of the trial, vide order dated 15.09.2021 passed in BLAPL No.3930 of 2020.

Mr. D.Panda, learned Counsel for the Petitioner submits that this Petitioner being released on bail after the order dated 15.09.2021 has been abiding by the all conditions including the other one as to his appearance in person on each date of posting of the case before the Trial Court. He further submits that in view of the lapse of time and when the Petitioner is appearing in person on every date of posting of the case before the Trial Court, prevalence of the condition as to his appearance at the Police Station is standing too harsh and stands without any purpose and therefore, the same be waived.

Learned Counsel for the State does not dispute the position that the Petitioner has been abiding by all the terms and conditions which had been imposed on him for his release on bail.

Considering the submissions made and on going through averments taken in the petition as well as the earlier order dated 15.09.2021 with the conduct of the Petitioner all through, the prayer as advanced in the application is allowed. The condition with regard to the appearance of before the IIC, Sahidnagar P.S. every Monday in between 10 am to 02 pm is waived.

The I.A. is accordingly disposed of.
