This matter is taken up by video conferencing mode.

Mr. Dinesh Kumar Mohanty, learned counsel for the Petitioner and Mr. Ramdas Achary, learned counsel for the Informant under instruction submit that in the meantime the dispute giving rise to the initiation of the criminal case has been amicably resolved and the parties have arrived at a settlement which has been worked out. It is also submitted that in that light, the parties are now contemplating to file a proceeding under section 482 Cr.P.C. for quashment of the criminal case.

Learned counsel for the State submits to have received no such instruction as above.

Considering the submissions and on going through the nature of accusations; further keeping in view the surrounding circumstances of the case as also concerning the Petitioner and

in the absence of any other impediment, it is directed that in the event the Petitioner surrenders before the Court in seisin of the case in Badagad P.S. Case No.77 of 2019 corresponding to C.T. Case No.1358 of 2019 pending on the file of learned S.D.J.M., Bhubaneswar, within three weeks hence and moves for their release on bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the said court.

5. The ABLAPL is accordingly disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court’s Notice No.4587, dated 25^th March, 2020 as modified by Court’s Notice No.4798, dated 15^th April, 2021.
