P.S. Case No.41 of 2018, corresponding to C.T. No.364 of 2018, pending in the court of J.M.F.C., Jaleswar registered for alleged commission of offences punishable under Sections 341, 323, 325, 294, 307 and 506/34of the I.P.C., have filed this petition for their release on pre-arrest bail.

Heard the learned counsel for the Petitioners and learned counsel for the State.

Perused the Case Diary along with other materials available on record.

It appears that the injured was assaulted in this case by the villagers including the present Petitioners apprehending that he is picked up the children.

Learned counsel for the State-Opposite Party submits that the injured has since been discharged from the hospital, so also investigation in this case has been completed and charge sheet has been submitted in the meanwhile.

Considering the aforesaid facts and submissions made, this Court directs that if the Petitioners surrender before the Court in seisin over the matter and make a motion for bail, the Court in seisin over the matter shall release them on bail in connection with the aforesaid case on such terms and conditions as it may deem just and proper.

However, it is made clear that this order is not an impediment on the part of the police to proceed against the Petitioners in accordance with law for their apprehension before they surrender, if the police so desired.

The ABLAPL is, accordingly, disposed of being allowed.

Urgent certified copy of this order be granted on proper application.
