ABLAPL NO. 2534 OF 2020
This is the second journey of the Petitioner in filing this application under section 438 of the Cr.P.C. for his grant of bail in the event of his arrest in connection with Simulia P.S. Case No. 224 of 2019 corresponding to C.T. Case No. 740 of 2020 on the file of learned J.M.F.C., Soro running for alleged commission of offence under section 376/506 of the IPC.
Heard learned counsel for the Petitioner and the learned counsel for the State.
Considering the submission made and on going through the averments taken in the petition, this Court finds that the prayer as advanced in the petition does not merit acceptance.
In view of the above, the date fixed for surrender of the Petitioner before the court in seisin of the case, in terms of the order passed in ABLAPL No.13592 of 2019, however, is extended by fifteen days more with effect from today.
The ABLAPL is accordingly disposed of.
As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court’s Notice No.4587, dated 25th March, 2020 as modified by Court’s Notice No.4798 dated 15th April, 2021.
