06 17.11.2020 This matter is taken up through Video Conferencing mode because of COVID-19 pandemic.
None appears for the petitioner when the matter is called.
Mr. M.S.Sahoo, learned Addl. Government Advocate has submitted the relevant documents through Court’s E.mail before this Court, which shows that the victim girl has been rescued and in her statements under Section 161 Cr.P.C. as well as 164 Cr.P.C., she stated that she wanted to stay with her Aunt, namely, Mana Mallick at Sisua, Bentakar, Cutack and that she is 19 years of age and does not want to stay in short stay home. It has been disclosed by the victim and also borne out from the school leaving certificate that the victim is a major.
In that view of the matter, the W.P. (CRL) has become infructuos and is disposed of as such.

In view of the office note, since there is no delay in filing the appeal, in the light of observation made by the Hon’ble Supreme Court in COVID-19 pandemic situation, the application for condonation of delay is disposed of as infructuous.
