Heard Mr. K.K. Swain, learned counsel for the petitioners and Mr. K.K. Rath, learned Standing Counsel for School and Mass Education Department.

The petitioners have filed this writ petition to quash the common gradation list under Annexure-6 and they further seek direction to opposite parties no.1 and 2 to prepare separate gradation lists for teachers of old Government High Schools and new Government High Schools/taken over High Schools and the vacancies in the Senior SES cadre be filled up from their own category without encroaching upon vacancies of other category.

Mr. K.K. Swain, learned counsel for the petitioners, in course of argument, contended that he does not press the prayer at this moment. But, he contended that though the petitioners have already raised objection to the provisional gradation list prepared by the authority, the same is still pending for consideration. Therefore, he contended that let direction be issued to opposite parties no.1 and 2 to consider the objections before finalize the gradation list.

Mr. K.K. Rath, learned Standing Counsel for School and Mass Education Department contended that since the provisional gradation list has been published, even if the petitioners have filed objection and the

same has not been considered, the provisional gradation list be considered as final gradation list.

Considering the contentions raised by learned counsel for the parties and after going through the records, it is the admitted fact that opposite parties no.1 and 2 have published the provisional gradation list, to which the petitioners have raised their objection and the said objection is still pending for consideration. Therefore, this Court, instead of keeping the matter pending, disposes of the writ petition directing opposite parties no.1 and 2 to consider the objection filed by the petitioners to the provisional gradation list before publication of final gradation list within a period of three months from the date of production/communication of the authenticated/certified copy of this order.
