Mr. Das, learned counsel for the petitioners submits that although the predecessor of the petitioners was the recorded tenant of the land in question, the opposite party no.5 without impleading them as parties, filed Mutation Case No.3777 of 2012 which was dismissed. Assailing the same, the opposite party no.5 preferred Mutation Appeal No.267 of 2016, which was disposed of by the SubCollector, Bhubaneswar vide order under Annexure-1 setting aside the order passed in Mutation Case No.3777 of 2012 and remitting the matter back to the Tahasildar, Jatni for fresh adjudication of the mutation case. It is his submission that the petitioners are necessary parties to the mutation case. But neither they have been impleaded as parties in mutation case nor they have been served with any notice. Thus, they apprehend that the Tahasildar, Jatni may not give any opportunity of hearing to them. Hence, the petitioners have filed this writ petition for a
