Heard learned counsel for the petitioner and learned Addl. Government Advocate for the State.

Petitioner in this writ petition seeks for a direction to the opposite parties more particularly opposite party party No.3-Special Land Acquisition Officer, NALCO in the district of Angul to give rehabilitation and resettlement benefit under the provisions of the Orissa Resettlement and Rehabilitation Policy, 2006 being land oustee.

It is contended by the petitioner that pursuant to the Government notification the land of the petitioner was acquired in mouza Kulad and award was passed. In the meantime petitioner has already received the compensation amount. He further submits in the notification it was specifically stated that Orissa Resettlement and Rehabilitation Policy, 2006 is to be implemented in respect of the land oustees. The petitioner has also approached the Collector, Angul on 5.12.2018 to give him benefit under the Orissa Resettlement and Rehabilitation Policy, 2006. Accordingly an enquiry was made and thereafter the Special Land Acquisition Officer, NALCO, Angul sent a letter to General manager, H& A(S&P), NALCO, Angul on 7.1.2019 vide Annexure-3 by recognising the petitioner as land oustee at serial No.13 and recommended the name of the petitioner for consideration of a job in NALCO. Thereafter the petitioner has also filed a representation before the authority on 19.11.2019 to give the benefit under the Orissa Resettlement

and Rehabilitation Policy, 2006 and the same is still pending.

Considering the above, we dispose of the writ petition with a direction to opposite party Nos. 2 and 3 i.e. Collector, Angul and Special Land Acquisition Officer, Angul to take consequential step regarding the benefit of rehabilitation and resettlement under the Orissa Resettlement and Rehabilitation Policy, 2006 since he is a land ousteee. The above exercise shall be completed within a period of four weeks.
