In course of hearing, learned counsel for the petitioners prays for withdrawal of this writ application with liberty to file the appeal as provided under section 12 of the OPLE Act before the appropriate authority in questioning the order of eviction of the petitioners in respect of the land in question as has been passed by the opposite party no.3 in Encroachment Case No.33 of 2019.
Granting the liberty as aforesaid, this writ application stands disposed of as withdrawn with further observation that in the event, the petitioners present the memorandum of appeal before the appropriate authority as prescribed under the law, the same shall be considered on its own merit and disposed of in accordance with law.
