Heard learned counsel for the petitioners.

Petitioners in this writ petition seek for a direction to opposite party No.2-Managing Director, Odisha Mining Corporation, Bhubaneswar to pay the unpaid wages of petitioner Nos. 2 to 42 for the period from 1.12.2016 to 31.8.2017 within a stipulated time.

Learned counsel for the petitioners submits that petitioner is a worker’s union duly registered under Trade Union Act, 1926 having its registered office at Koira in the district of Sundargarh and operating trade union activities at different placed in the State of Odisha. Petitioner Nos. 2 to 42 and others were deployment by the OMC Koira Regional Office at different mining check gates of OMC were attending their duties at different shifts as per the instruction of the concerned Personal Officer of the OMC. While working as such the opposite party No.5 who had engaged the petitioners as security guards under OMC, did not disburse wages to petitioner Nos. 2 to 42 and others from the month of December, 2016. Reiterating the aforesaid grievance the petitioners have filed a representation before Deputy Labour Commissioner-cum-Conciliation Officer, Sundargarh and District Labour Officer, Sundargarh on 13.8.2020 and the same is still pending. Hence the present writ petition.

Considering the above and without going into the merits of the case, we dispose of writ petition with an observation that the opposite parties shall consider the

representation of the petitioners within a period of four weeks from the date of production of a copy of the order and result thereof shall be communicated to the petitioners.
