Petitioner made a representation to the Collector-cum-Election Officer, Kalahandi vide Annexure3 series involving a claim of compensation on account of damage of his vehicle while it was used in the election duty. On receipt of the representation of the petitioner, it appears vide Annexure-4 that the representation has been referred to the Collector and D.E.O., Kandhamal for appropriate action at their level. Vide Annexure-5, it appears that the Regional Transport Officer, Kandhamal has made a correspondence to the Transport Commissioner, STA, Orissa, Cuttack that the claim of the petitioner has not yet been determined. On the other hand, petitioner has been forced to move from post to pillar and there is no development involving such claim.
Keeping this in view and since there is material establishing the damage of the vehicle by the Maoist during the election period, this Court directs the opposite party no.1 to treat the writ petition as representation and take a decision as appropriate taking into consideration the development taken place in the writ petition by directing all concern authorities and also giving liberty of hearing to the petitioner. exercise shall be completed within a period of two months.
Writ petition is accordingly disposed of. A free copy of this order be handed over to learned counsel for the State for appropriate action.
