Heard learned counsel for the parties.

The petitioner in this writ petition has prayed for a direction for revocation of his order of suspension dated 19.09.2019 (Annexure-1).

Learned counsel for the petitioner submits that the petitioner was put under suspension for his alleged involvement in a criminal case vide order dated 19.09.2019 contemplating the disciplinary proceeding against him. Although the charge sheet has already been filed in the said criminal case, neither any disciplinary proceeding has been initiated against him nor the order of suspension under Annexure-1 has been revoked. In that regard, the petitioner has made a representation to the Superintendent of Police, Balasore-opposite party no.3 on 28.04.2020 as at Annexure-4, but the same has not yet been disposed of. He, therefore, prays for a direction for early consideration of the representation of the petitioner and to revoke the order of suspension.

Mr. A.K. Mishra, learned Additional Government Advocate for the State submits that he has no instruction with regard to the status of the representation stated to have been submitted by the petitioner. If the said representation under Annexure-4 is still pending with opposite party no.3, the same may be considered on its own merit at an early date.

Taking into consideration the submissions of learned counsel for the parties, this Court without expressing any opinion on the merits of the case disposes of this writ petition with a direction that the Superintendent of Police, Balasore-opposite party no.3 shall do well to consider and dispose of the representation of the petitioner dated 28.04.2020 as at Annexure-4 on its own merit, if the same is still pending before him, as expeditiously as possible preferably within a period of six weeks from the date of production of an authenticated copy of this order downloaded from the website of the Orissa High Court.

Authenticated copy of this order downloaded from the website of this Court shall be treated at par with certified copy in the manner prescribed in this Court’s Notice No.4587 dated 25.03.2020.
