Heard learned counsel for the parties by Video Conferencing mode.

This writ petition has been filed by the petitioners challenging the order dated 16.11.2019 (Annexure-6) passed by opposite party no.1 by which the engagement order issued to the petitioners for engagement of 5 Nos of Peons, 4 No of Chowkidar and 1 No of Driver vide Office Letter No.254 dated 25.02.2019 is cancelled for the following reasons:

Financial formalities and Govt. guideline have not been followed at the time of selection of service provider.

No transparency has been maintained at the selection process of service provider.

Sponsored candidates by the service provider for 5 Nos. of Peons, 4 Nos. of Chowkidar and one No. of Driver have not yet joined in this establishment.

This writ petition has been filed belatedly in June, 2020 which is almost seven months since the impugned order was passed and it is about eleven months the opposite parties have issued fresh tender call notice. Therefore, at this stage this Court does not deem it appropriate to entertain the writ

petition. So far as other prayer regarding direction to opposite party no.1 to release the monthly bills of the petitioner as per the agreement is concerned, the same also cannot be entertained. However, the petitioner may approach the opposite parties for that purpose and if his grievances are not redressed, he may approach the appropriate court and for recovery of due amount in accordance with law.

The writ petition is accordingly dismissed.

As Lock-down period is continuing for COVID-19, learned counsel may utilize the soft copy of this order available in the High Court’s website or print out thereof at par with certified copies in the manner prescribed, vide Court’s Notice No.4587, dated 25.03.2020.
