Petitioners in this writ petition seek for a direction to the opposite parties to comply the order dated 10.3.2017 passed by the Orissa Administrative Tribunal, Cuttack in O.A. No. 404(C) of 2015 and to release the arrears and to regularize their services.

Earlier petitioners have approached the Orissa Administrative Tribunal, Cuttack in O.A. No. 404(C) of 2015 which was disposed of on 10.3.2017 with the following directions:-

“In view of the admission in the counter, the respondents are directed to release the enhanced arrear consolidated pay at the rate of Rs.5200 P.M. from the date of joining of the applicant till their regularization, within a period of three months from the date of receipt of a copy of this order, failing which the arrear dues shall be paid within 7% interest thereon. So far as regularization is concerned, the respondents are directed to take a decision in terms of G.A. Department Notification dated 17.9.2013 to regularize the service of the applicants after completion of six years of their contractual appointment.”

The aforesaid Tribunal order was challenged by

the Department in W.P.(C) No. 14761 of 2018 which was disposed of on 24.1.2019 by confirming the order of the Tribunal. Though one year and six months already passed in the meantime till date the order has not been complied with even though a direction was given to take a decision in terms of G.A. Department Notification dated 17.9.2013. Petitioners have completed six years on contractual service in the

meantime. Since the order of the Court has not been complied with petitioners have approached this Court in the present writ petition for compliance of the aforesaid order and for regularization of service.

Considering the above, this Court disposes of the writ petition with a direction to opposite party No.1 to comply the Court’s order within a period of three months from today.
