Heard Mr. J.K. Khuntia, learned counsel for opposite party no.2.
The petitioner has filed this writ petition seeking to quash Annexures-12 and 13, by which the service of the petitioner has been terminated from the R.C.M.S. with effect from 01.01.2004.
Challenging the aforesaid orders passed in Annexures-12 and 13, this writ petition has been filed and this Court while entertaining this application, vide order dated 24.12.2003, passed interim order to the extent that the service of the petitioner would not be terminated for a period of eight weeks and, as such, the said interim order was continued from time to time. By virtue of the interim order, the petitioner continued in service till he superannuated from service on attaining the age of 60 years.
Mr. J.K. Khuntia, learned counsel for opposite party no.2 contended that since the petitioner has already retired from service on attaining the age of superannuation, nothing more survives to be adjudicated by this Court in the present writ petition. As such, the writ petition has become infructuous.
In view of the above submission, by efflux of time, the writ petition has become infructuous. Accordingly, the writ petition stands disposed of.
