Heard learned counsel appearing for the parties. This is a writ petition seeking implementation of the decision taken in 14th meeting dated 27.2.2008 and 17th meeting dated 10.2.2009 of the opposite party no.1 in the matter of absorption of the petitioner in the created post.
During course of submission, a statement is made by Sri Panigrahi, learned counsel for the opposite party nos.1 to 3 that in the meantime s many as 12 petitioners have already been absorbed and only 2 cases have been left. For the provision at Rule 6 of the PKDA Rules, this Court finds there is no need for getting sanction of the appropriate Government for regular absorption of the rest 2 persons looking to the particular cadre which is already in the domain of the PKDA as submitted by Sri Panigrahi. In the circumstance this Court finds there is no reason in not absorbing the rest 2 persons, who have already stood in the same footing and looking to their long continuance in the particular establishment.
In the circumstances, this Court in disposal of the writ petition directs the Puri-Konark Development Authority to take immediate steps for absorption of petitioner nos. 9 and 14 by taking appropriate steps within a period of six weeks from the date of communication of certified copy of this order by the petitioners.
