It is submitted at the Bar that the auction having failed in the meantime, the petitioner proposes to approach the Bank for settlement of the matter.
In view of such submission, we dispose of the writ application directing the petitioner to file a detailed representation before the concerned Bank within three weeks from today. If such representation is filed within the stipulated time, the same shall be disposed of, taking into consideration the interest of the petitioner and the interest of the Bank. The representation be disposed of within a period of two months from the date of its filing.
Till disposal of the representation, no coercive action shall be taken against the petitioner. The writ application is accordingly disposed of.
As Lock-down period is continuing for COVID-19, learned counsel for the petitioner may utilize the soft copy of this order available in the High Court’s website or print out thereof at par with certified copies in the manner prescribed, vide Court’s Notice No.4587, dated 25.03.2020.
