This matter is taken up today in the Micro Level E- Lok Adalat through video conferencing mode because of COVID-19.
Learned counsels for the claimant- appellants Mr Satyabhushan Das and the respondent insurance companyMr G.P. Dutta are present. The memo of compromise of the parties be kept on record . It is stated by the learned counsel for the claimant- appellants that the appellant no.1 Bhaskar Jena has died during pendency of appeal , but as his legal heirs are already on record, his name may be deleted . In support of such submission , he has filed a memo which is taken on record.
It is agreed by the parties that a further consolidated amount of Rs.1,00,000/- (Rupees one lakh only) over and above the awarded amount shall be paid by the insurance company to the claimants- appellants within a period of eight weeks .
It is therefore directed that the respondentinsurance company shall deposit the agreed amount Rs.1,00,000/- within a period of eight weeks from today. The tribunal shall release the amount in favour of the remaining three claimants after satisfying itself about the death of claimant Bhaskar Jena.
As the settlement is arrived at before the Lok Adalat,
no court fee shall be levied on the claimants .
The MACA is accordingly disposed of.
