Heard learned counsel for the appellant, informant and learned State counsel.

This appeal under Section 14(A)(2) of SC & ST (POA) Act is against the order dtd.04.08.2020 of learned Special Judge, Puri refusing bail to the appellant Sakhawat Khan in connection with Spl. G.R. Case No.85 of 2020 arising out of Pipili P.S. Case No.203 of 2020 pending in his file for alleged commission of offence under Sections 376(2)(n)/294/354(A)/354(B)/313/506 of the Indian Penal Code read with Section 3(1)(x)(s)/3(2)(v)(va) of SC & ST (POA) Act.

It is submitted on behalf of the appellant that he is inside custody since 21.07.2020 and all the false allegations have been leveled against him. It is further submitted that in the meantime investigation has been completed and charge-sheet has been submitted.

After hearing learned counsel for the State as well as informant and considering the circumstances of the case so also the statement of victim and the age of both parties, it is directed to release the appellant on bail in the aforesaid case on such terms and conditions to be fixed by the learned court in seisin over the matter including the conditions that he shall not dissuade any witness directly or indirectly by way of inducement, threat or promise acquainted with the facts of the case from disclosing such facts before the Court or tamper with the evidence.
