Heard learned counsel for the petitioner and Additional Standing Counsel for the Vigilance Department.

This is an application under section 439 of Cr.P.C. in connection with G.R.(V) Case No.14 of 2020 arising out of Koraput Vigilance P.S. Case No.18 of 2020 pending in the Court of learned Addl. Sessions Judge -cum- Special Judge (Vigilance), Bhawanipatna for offence punishable under section 7 of the Prevention of Corruption (Amendment) Act, 2018.

The petitioner moved an application for bail before the Court of learned Special Judge (Vigilance), Bhawanipatna which was rejected on 25.09.2020.

Considering the submission made by the learned counsel for the petitioner that the petitioner was working as G.R.S. in Balsi Gram Panchayat under Kesinga Block in the district of Kalahandi and he is in judicial custody since 18.08.2020 and the investigation has made substantial progress and there is no chance of absconding of the petitioner and on hearing the learned Additional Standing Counsel for the Vigilance Department, who submitted that the trap was successful

in the case, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000.00 (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper subject to conditions that he shall cooperate with the investigation and shall appear before the Investigating Officer as and when necessary and shall not try to tamper with the evidence and he shall also appear before the learned trial Court on each date when the case would be posted for trial.

Violation of any terms and conditions shall entail cancellation of bail.

The BLAPL is accordingly disposed of.
