01.10.2020 This application under Section 439 Cr.P.C. has been made on 03.09.2020 by the petitioner, namely, B. Aditya Narayan @ Liku in connection with Bonai P.S. Case No. 94 of 2020 corresponding to G.R. Case No. 382 of 2020 under Section 394 of the I.P.C., pending in the court of learned SDJM, Bonai, Sundargarh.

In view of extra-ordinary situation arose out of COVID-19 Pandemic, the matter is taken up through video

conferencing.

Heard learned counsel for the petitioner and

learned counsel for the State.

Learned counsel for the petitioner submits that there is no criminal antecedent against the present petitioner. He further submits that co-accused Debashish Jautuki2a, who stands on equal footing with that of the present petitioner has already been released on bail vide order dated 21.08.2020 in BLAPL No. 5218 of 2020.Petitioner is in custody since 16.07.2020. Chance of absconding is remote for having root in village-Patnasahi, P.S. Bonai, Dist. Sundargarh.

Having regards to the nature of accusation and period of detention, I am inclined to extend the benefit of Sec.439 Cr.P.C. to the petitioner.

Hence, it is ordered that the petitioner be released on bail on furnishing bail bond of Rs. 20,000/(Rupees Twenty Thousand) with one surety for the like amount to the satisfaction of the learned SDJM, Bonai in the aforesaid case, subject to such terms and conditions as deemed just and proper by the learned court below.

The bail application is accordingly disposed of.
