Heard learned counsel for the petitioner and the learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with C.T. Case No.243 of 2018 arising out of Attabira P.S. Case No.242 of 2018 pending in the Court of learned Sessions Judge, Bargarh for offences punishable under sections 366/506/376/511/34 of the Indian Penal Code.

The petitioner moved an application for bail before the Court of learned Sessions Judge, Bargarh which was rejected on 09.05.2019.

Learned counsel for the petitioner submitted that the petitioner is in judicial custody since 11.11.2018 and he has been charge sheeted under sections 366/506/376/511/34 of the Indian Penal Code. He further submitted that even though the case was committed to the Court of Session in the year 2019 but there is no progress in the trial and similarly situated co-accused Amit Badi has already been released on bail in BLAPL No.1389 of 2020 as per order dated 09.06.2020.

Learned counsel for the State on verification of the case diary and particularly the 164 Cr.P.C. statement of the victim fairly submitted that the petitioner is similarly situated like the co-accused Amit Badi.

In view of such submission made by the learned counsel for the respective parties, taking into account the period of detention of the petitioner in judicial custody and release of similarly situated coaccused on bail, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.20,000/(rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with further conditions as the learned Court may deem just and proper.

The BLAPL is accordingly disposed of.
