Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with S.T. Case No.15 of 2019 arising out of Bamebari P.S. Case No.140 of 2018 pending in the Court of learned Addl. Sessions Judge, Champua for offences punishable under section 302/34 of the Indian Penal Code.

The petitioner moved an application for bail before the Court of learned Addl. Sessions Judge, Champua which was rejected on 24.01.2019.

Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 10.11.2018 and she is the mother of the deceased and there are no eye witnesses to the occurrence and though the case has already been committed to the Court of Session but there is no progress in the trial and further considering the submission of learned counsel for the State that there is extra judicial confession of the petitioner and leading to discovery of split wood and further taking into account the proviso to section 437 (1) of Cr.P.C, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000.00 (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.

The BLAPL is accordingly disposed of.
