Heard learned counsel for the petitioner and the learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with G.R. Case No.2507 of 2020 arising out of Sasan P.S. Case No.123 of 2020 pending in the Court of learned S.D.J.M., Sambalpur for offences punishable under sections 364/394/120-B of the Indian Penal Code read with sections 25/27 of the Arms Act.

The petitioner moved an application for bail before the Court of learned Additional Sessions Judge, Sambalpur which was rejected on 06.08.2020.

Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 16.07.2020 and charge sheet has been submitted under sections 364/394/120-B of the Indian Penal Code read with sections 25/27 of the Arms Act and one Naresh Kumar Agarwal was kidnapped on 10.07.2020 and he was rescued on 11.07.2020 and he has not implicated the petitioner in the alleged crime and there is no clinching material available against the petitioner and after hearing the learned counsel for the State, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.20,000.00 (rupees twenty thousand) with two solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.

The BLAPL is accordingly disposed of.
