This is an application under section 439 of Cr.P.C. for grant of bail to the petitioners in connection with Bhatli P.S. Case No. 48 of 2020 corresponding to C.T. Case No. 277 of 2020 pending in the Court of learned S.D.J.M., Bargarh registered for commission of offences punishable under Sections 399/402 IPC and Sections 25/27 of the Arms Act.
The petitioners had moved an application for bail before the Court of learned Sessions Judge, Bargarh which was rejected on 08.06.2020.
Learned counsel for the petitioners states that the investigation in this case has been completed and charge sheet has been filed and co-accused standing on the similar footing has been released on bail by this Hon’ble Court in BLAPL No.4053 of 2020. Learned counsel for the petitioners files a xerox copy of the charge sheet along with xerox copy of the bail order

dated 29.06.2020 in respect of the co-accused namely Ramlal Dansana in BLAPL No.4053 of 2020, which are taken on record.
The allegations in brief against the petitioners and other co-accused is that they were caught red handed while preparing to commit docoity and lethal weapons were seized from their possession and they confessed that they were involved in several crimes in Bargarh.
Keeping in mind, the nature of allegations and the fact that the petitioners are in custody since 21.03.2020 and that charge sheet has been submitted and one of the co-accused standing on similar footing has been released on bail by the Hon’ble Court, it is directed that the petitioners be released on bail on such terms and conditions as may be fixed by the learned Court below in seisin of the matter including the condition that they will not indulge in any criminal activity while on bail.
The BLAPL is accordingly disposed of.
