This is an application under Section 439, Cr.P.C. for grant of bail to the petitioners in connection with Phulbani Town P.S. Case No.134 of 2019 corresponding to C.T. Case No.389 of 2019 pending in the court of the learned S.D.J.M., Phulbani for the alleged commission of offences under Sections 392 of the I.P.C.
Considering the rival submissions made by the learned counsel for the parties and having regard to the length of detention in custody of the petitioners, I am inclined to allow this bail application and direct that each of the petitioners be released on bail on executing bond of Rs.20,000/- (Rupees twenty thousand) with two local solvent sureties each for the like amount to the satisfaction of the learned S.D.J.M., Phulbani in connection with the aforesaid case subject to the following conditions:
(i) they shall appear before the concerned police station once in a fortnight without fail.
- (ii) they shall not abscond or involve themselves similar offences while on bail;
- (iii) they shall not try to influence or terrorize the witnesses of the prosecution in any manner.
