Heard learned counsel for the petitioner and the learned counsel for the State as well as learned counsel for the informant.

This is an application under section 439 of Cr.P.C. in connection with G.R. Case No.1102 of 2019 arising out of Jharpokharia P.S. Case No.125 of 2019 pending in the Court of learned S.D.J.M., Baripada for commission of offences punishable under sections 376(1)/201/506/34 of the Indian Penal Code.

The petitioner moved an application for bail before the Court of learned Additional Sessions Judge -cum- Special Judge (Vigilance), Baripada which was rejected on 19.02.2020.

Learned counsel for the petitioner submits that the petitioner is in judicial custody since 01.12.2019 and he has been charge sheeted under sections 376(1)/201/506/34 of the Indian Penal Code and it appears to be a case of consent and therefore, the bail application of the petitioner may be favourably considered.

Learned counsel for the State has produced the case diary and placed the 164 Cr.P.C. statement of the

victim who is aged about twenty three years and it appears that she is related to the petitioner.

Learned counsel for the informant opposes the prayer for bail and submitted that subsequently the victim committed suicide for which another case has been instituted against the petitioner.

Considering the submissions made by the learned counsel for both the parties, the nature of accusation against the petitioner, the surrounding circumstances under which the offence has been committed, the 164 Cr.P.C. statement of the victim and taking into account the period of detention of the petitioner in judicial custody, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.50,000.00 (rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the Court in seisin over the matter with further terms and conditions as the learned Court may deem just and proper.

The BLAPL is accordingly disposed of.
