Heard learned counsel for the petitioner and learned Counsel for the State through Video Conferencing.

This is an application under Section 439 Cr.P.C. for grant of bail to the petitioner in connection with G.R.Case No. 1413 of 2019, arising out of Marsaghai P.S.Case No. 229 of 2019, pending in the court of learned S.D.J.M., Kendrapara for alleged commission of offences under Sections 302/120-B of I.P.C. and Section 25/27 of the Arms Act.

It is submitted on behalf of the petitioner that investigation has been completed and there is no direct material against the petitioner to implicate in the alleged offences and also there is discrepancy in identification of the vehicle of the petitioner in which he allegedly moved at the time of occurrence. It is further submitted that other co-accused persons have already been released on bail by this Court.

On the other hand, it is submitted by the learned counsel for the State as well as learned counsel for the informant that there are materials in the statements of the witnesses to reveal the presence of the petitioner at the spot during the occurrence and this petitioner has criminal antecedents. Therefore, what is submitted by the petitioner about release some other co-accused persons cannot be taken in benefit of this petitioner as the ground for parity.

Having heard all the parties and considering the materials available against this petitioner about his presence at the spot as well as the fact of criminal antecedents, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail is rejected.

However, as prayed by the counsel for the petitioner the trial court is directed to expedite the trial.
