10.09.2020 In the wake of the pandemic Covid-19, the case is taken up through V.C.

The petitioners apprehending their arrest in Laxmipur P.S. Case No.31 of 2020, corresponding to G.R. Case No.105 of 2020, pending in the court of J.M.F.C., Laxmipur, registered for alleged commission of offences punishable under Sections 147, 148, 323, 294, 506, 283 and 149 of the I.P.C. read with Section 7 of the Criminal Law Amendment Act, 2013, have filed this petition for his release on pre-arrest bail.

Heard, learned counsel for the petitioners and learned counsel for the State.

Learned counsel for the petitioners submits that since co-accused persons, namely, Basanta Khora and Sulachana Kandapan standing on the same footing with the present petitioners have already been released on pre-arrest bail vide order dated 12.06.2020 and 25.06.2020 passed by this Court in ABLAPL Nos.6499 and 6546 of 2020

respectively, the petitioners may be released on pre-arrest bail.

Learned counsel for the State does not dispute the

same.

Considering the aforesaid submission, this Court directs that in the event of arrest of the petitioners in connection with the aforesaid case, they be released on bail by the Officer effecting arrest on such terms and conditions as deemed just and proper.

However, the aforesaid order is subject to the condition that the petitioners shall cooperate with the investigation and no other graver offence is reported against the petitioner besides the aforesaid offences.

The ABLAPL is, accordingly, disposed of being allowed.

Due to difficulties faced by the parties in getting the certified copies of this order and in view of the Court’s Notice No.4587 dated 25.03.2020, if a printout of the copy of this order from the website of the High Court is produced by the party duly attested by him to be the true copy, the same be treated at par with the certified copy and the direction be complied with.
